JENNIES CREEK – Three persons face felony charges for allegedly attempting to operate and conspiring to operate a clandestine laboratory in the Jennies Creek area of Mingo County.
Shawn Davis, 34, Patricia Spurlock 49, and Randy Hodge 51, all from the Kermit area were arrested Thursday, October 13 on felony charges by officers with the Kermit Police Department and troopers from the Williamson Detachment of the West Virginia State Police (WVSP).
According to criminal complaints, the three individuals conspired to attempt to operate a clandestine drug laboratory.
The complaint states that the officers found several ingredients that, based upon their training, led them to believe were used for a clandestine drug laboratory.
The officers then requested the help of a methamphetamine technician with the WVSP who assisted in the investigation.
The three were arraigned before Mingo County Magistrate Barry Marcum Friday, October 14.
According to the W.Va. State Code, “any person who operates or attempts to operate a clandestine drug laboratory Is guilty of a felony and if convicted shall be confined in a state correctional facility for not less than two years nor more than 10 years and/or fined no less than $5,000 nor more than $25,000.”
The W.Va. State Code explains the penalties associated with conspiracy as, “any person who violates the provisions of this section by conspiring to commit an offense against the state which is a felony, or by conspiring to defraud the state…shall be guilty of a felony and if convicted shall be punished by imprisonment in the penitentiary for not less than one more more than five years or by a fine of not more than $10,000, in the discretion of the court, by both such imprisonment and fine.”
