Four persons indicted by the April 2010 grand jury on drug charges and one charged with second degree robbery entered guilty pleas in Mingo County Circuit Court Friday.
Mingo County Prosecuting Attorney C. Michael Sparks said the five cases brought to 67 the number of felony convictions achieved by the prosecuting attorney's office this year.
Sparks reported that Lt. C.D. Rockel of the Williamson Police Department has earned special commendation for exceptional police work and productivity.
Chief Judge Michael Thornsbury accepted the pleas, imposing sentences on two defendants who waived pre-sentence investigations and setting sentencing dates for the three other defendants who entered guilty pleas.
– Noah Keith Bevins, 29, Williamson, pleaded guilty to attempt to deliver a Schedule I controlled substance (Marijuana), a lesser included offense of delivery of a Schedule I controlled substance (Marijuana), as charged in Count I of his April 2010 indictment.
Bevins waived a pre-sentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than one year nor more than three years. He was represented by Attorney W. Thomas Ward. Lt. Rockel was the investigating officer.
– Teresa Ann Harmon, 44, Kermit, pleaded guilty to delivery of a Schedule II controlled substance (Oxycodone), as charged in her April 2010 indictment, and to involuntary manslaughter, a misdemeanor as charged in an April 2010 information.
Harmon is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than one year nor more than 15 years for the delivery of a Schedule II controlled substance (Oxycodone) conviction, and one year for the involuntary manslaughter conviction. Her sentencing is set for 10:15 a.m. on Sept. 13.
Harmon was represented by Attorney Stacey Kohari. Cpl. N. Mines and Sgt. Joe Smith of the Mingo County Sheriff's Department were the investigating officers in the respective cases.
– Timothy Shawn Lester, age and address not available, pleaded guilty to attempt to the delivery of a Schedule I controlled substance (Marijuana) as charged in an April 2010 Information. He is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than one year nor more than three years, or confinement in a regional jail facility for a definite term of 12 months.
Lester, who is to be sentenced at 10 a.m. on Sept. 29, was represented by Attorney Diana Carter Wiedel. Senior Trooper B.R. Moore of the West Virginia State Police was the investigating officer. Lester was granted post-conviction bond with electronic home confinement and voluntary participation in the Judge's Work Program.
– Kimberly Stacy, 33, Lovely, Ky., pleaded guilty to conspiracy in delivery of a Schedule I controlled substance (Marijuana) as charged in Count I of an April 2010 felony indictment. Stacy is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than one year nor more than five years.
Stacy, who was represented by Attorney Charles Stanford West, is to be sentenced at 10 a.m. on Sept. 29. Meanwhile, Stacy will be under a post-conviction bond with electronic home confinement. Lt. Rockel and Senior Trooper Moore were the investigating officers.
– Adam Stephen Wicker, age and address not available, pleaded guilty to second degree robbery, as charged in his April 2010 felony indictment. He waived a pre-sentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than five years nor more than 18 years. Wicker was represented by Attorney Jerry M. Lyall. Lt. Rockel was the investigating officer.
