A woman was found guilty yesterday in Mingo County Magistrate Court of assaulting her niece and nephew-in-law at a funeral last year.

Michelle Preece’s trial was heard by Magistrate Eugene Crum on Aug. 11, when she was found guilty of one count of domestic assault and one count of domestic battery.

Preece was accused of striking her nephew-in-law and niece, Michael and Lindsey Miller with her vehicle. She was also accused of throwing a soda bottle at Michael. The events occurred almost a year ago on Oct. 18, 2008, at a funeral for Preece’s brother, who was also Lindsey’s father.

The criminal complaint filed by Trooper D.J. Chapman with the West Virginia State Police stated that the defendant threatened Mr. Miller with bodily harm before throwing a bottle of soda at him, which struck him.

The complaint further states that the defendant then used her car to physically pin her niece and nephew-in-law against another vehicle.

After hearing the testimonies and closing statements from both sides Magistrate Crum charged Preece with a $200 fine for one count of domestic battery and $100 foronegb count of domestic assault.
