WILLIAMSON - Two defendants were arrested and arraigned on charges stemming from separate incidents of driving under the influence, all by the same officer, Mingo County Sheriff’s Department Deputy M.J. Miller.
Anzie Brewer, 51, of Lenore, was arrested on charges of DUI, first offense, failure to yield and improper backing. According to the criminal complaint, Miller observed a 2009 Ford Ranger operated by Brewer backing onto the roadway from a parking lot onto Rt. 65 near Lenore, without yielding to oncoming traffic.
Miller engaged a traffic stop on the subject, and after making contact, detected a strong alcoholic beverage odor on the defendant’s breath. Brewer allegedly told the deputy he had consumed a couple of beers earlier that evening at a local bar.
The officer attempted to administer a three-part sobriety test to Brewer, which he failed. The defendant claimed that he was not able to complete the testing due to a medical condition. Brewer agreed to a secondary breathalyzer test after being advised of his implied consent warnings, which produced results of 0.199, well above the legal limit.
The second arrest made by Miller occurred near the Nolan Street exit off of U.S. 119, when the deputy, while on road patrol, observed a 2004 Dodge Stratus veer off the roadway onto the shoulder on three occasions. The deputy also seen that the inspection sticker had expired in March 2012, and after running a status check on the license and registration, was informed by dispatch they had also expired at the end of March.
The deputy conducted a traffic stop, and found the driver to be Christopher Lanier Drummer, 40, of Mount Gay in Logan County. Miller administered the three-part sobriety testing which includes the horizonyal gaze nystagmus, walk and turn and the one-legged stand. Drummer experienced problems completing all three tests, and at that point was asked to submit to a breathalyzer test. The defendant blew a 0.151 BAC, over the legal limit of 0.080.
Drummer was charged with second offense DUI, expired registration, driving on a revoked license for reasons of DUI and no proof of insurance.
