2 plead guilty in circuit court cases

WILLIAMSON - Mingo County Prosecuting Attorney C. Michael Sparks released information regarding pleas entered in two cases in circuit court this week. Judge Michael Thornsbury presided over the hearings.

Benny Lee Horn, 36, address unknown, pleaded guilty to conspiracy to commit grand larceny as charged in indictment J12-F11. Horn is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than one year, and not more than five years.

Horn was represented by Attorney David A. Foley. Sergeant Joe Smith of the Mingo County Sheriff’s Department was the investigation officer.

Kevin Lynn Smith, 39, of Turkey Creek, Ky., Horn’s accomplice, pleaded guilty to conspiracy to commit grand larceny as charged in indictment J12-F21. Smith also pleaded guilty to another count of conspiracy to commit grand larceny as charged in Information J12-F27. Smith is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than one year and not more than five years for each count.

Smith was represented by Attorney Ashley Cochran. Smith was the investigating officer in connection with both of these charges.

Both defendants were remanded to the Southwestern Regional Jail at Holden where they will await sentencing on March 26.
