BORDERLAND - A Mingo County man was arraigned over the weekend in Magistrate Court following his arrest by West Virginia State Police Trooper J.J. Dean on one felony count of use of minors in filming sexually explicit conduct prohibited.
In the criminal complaint filed by the trooper, he stated that Joseph Justice, 37, of Borderland, allegedly hid behind a partially opened bathroom door and recordeda 14-year-old girl as she was showering. Justice is further accused of recording the teenage girl a second time in the nude as she was changing clothes in her bedroom.
The complaint stated that the girl viewed the videos of herself on an iPod belonging to Justice and that is when she and her guardian contacted the trooper and filed the complaint.
WV Code 61-8C-2 states that any person who causes or knowingly permits, uses, persuades, induces, entices or coerces such minor to engage in or uses such minor to do or assist in any sexually explicit conduct shall be guilty of a felony when such person has knowledge that any such act is being photographed or filmed. Upon conviction thereof, such person shall be fined not more than ten thousand dollars, or imprisoned in the penitentiary not more than 10 years, or both fined and imprisoned.
Justice was arraigned before Magistrate Dallas Toler who set his bond at $50,000. Justice was transported to the Southwestern Regional Jail at Holden where he remains in custody. A preliminary hearing for Justice is scheduled for Tuesday, June 26, at 9 a.m.
