EAST WILLIAMSON – The Williamson Police Department (WPD), assisted by the West Virginia State Police (WVSP), arrested a 22-year old man at a residence in East Williamson Tuesday evening on charges of first and third degree sexual assault against two young female victims.
WPD Chief Barry Blair identified the man as Maximo Ayala, Jr. who had been residing at a home on Peter Street.
Blair said the victims were 7-years old and 14-years old.
The Criminal Complaint states that the 14 year old is “believed to be pregnant and currently has a 5-month old child –with great probability that both belong to the accused.”
The suspect had been staying at the home of the girls.
Blair said further charges are pending against the parents of the young victims.
Blair enlisted the aid of WVSP Sgt. Dale Hensley, who specializes in these types of cases.
Ayala was arraigned before Mingo County Magistrate Dee Sidebottom and bond was set at $200,000. He is currently lodged in the Southwestern Regional Jail at Holden.
Felony First Degree Sexual Assault states the person engages in sexual intercourse or sexual intrusion with another person, and in doing so, inflicts serious bodily injury. It further states that if the suspect is 18 years old or older and if the victim is younger than 12 years of age, shall be imprisoned in a state correctional facility for not less than 25 years or more than 100 years. A fine can also be issued up to $25,000, but not less than $5,000.
A Third Degree Sexual Assault conviction would be not more than five years or less than one year and up to a $10,000 fine.
